WORD OF MOUTH – TERMS & CONDITIONS

1. Introduction

These Terms and Conditions govern your use of the Word of Mouth platform. By registering and using our services, you agree to be bound by these terms. Word of Mouth is a registered legal entity operating under the laws of South Africa.

2. Definitions

  • Casual Referrer: A person who refers a property lead without a paid subscription.
  • Lead Generator: A subscribed member who actively generates and submits property leads.
  • Service Provider: A verified property professional (estate agent, developer, etc.) who receives qualified leads.
  • Lead: A potential property buyer, seller, or landlord referred through our platform.
  • Verified Lead: A lead that has been confirmed as legitimate by our verification process.
  • Referral Fee: The commission paid to Lead Generators and Casual Referrers on successful property transactions.

3. Services Provided

Word of Mouth provides an online platform that connects Lead Generators with Property Service Providers. We reserve the right to modify or discontinue services at any time with reasonable notice.

4. Membership Packages, Fees & Annual Renewals

4.1 Casual Referrers

No registration fee. Casual Referrers earn R1,000 per verified lead that results in a successful property transaction.

4.2 Lead Generator Packages

  • Silver: R999 once-off — 10% referral fee on successful transactions
  • Gold: R4,999 once-off — 15% referral fee on successful transactions
  • Platinum: R9,999 once-off — 20% referral fee on successful transactions

4.3 Annual Renewal Fee

An annual renewal fee of 10% of the original registration fee applies to all Lead Generator packages.

4.4 Service Provider Package

R9,999 once-off registration fee. Annual renewal: R999.90.

4.5 Payment Terms

All fees are non-refundable except as required under the Consumer Protection Act (CPA).

5. Referral Fees

Referral fees are paid only upon successful, verified property transactions. All leads must be submitted through the platform and verified before any fees are payable.

6. User Responsibilities

All users must provide truthful and accurate information. You are responsible for compliance with POPIA when submitting personal information of leads. Fraudulent or misleading submissions will result in immediate account termination.

7. Platform Availability

We strive for maximum uptime but cannot guarantee uninterrupted service. Maintenance windows will be communicated in advance where possible.

8. POPIA Compliance & Data Sharing Consent

By using our platform, you consent to the collection and processing of your personal information as described in our Privacy Policy. You confirm that any leads you submit have consented to their information being shared through our platform.

9. Refund Policy

Registration fees are generally non-refundable. Refunds may be considered in exceptional circumstances as required by the Consumer Protection Act.

10. Compliance With Property Practitioners Act

Service Providers must hold a valid Fidelity Fund Certificate (FFC) as required by the Property Practitioners Act. Word of Mouth does not act as a property practitioner.

11. Termination & Suspension

We reserve the right to suspend or terminate any account found to be in breach of these terms, involved in fraudulent activity, or acting contrary to the best interests of the platform and its users.

12. Limitation of Liability

Word of Mouth’s liability is limited to the fees paid by the user in the 12 months preceding any claim. We are not liable for indirect, consequential, or incidental damages.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in South African courts.
